Terms of Service

Welcome to Nukes & Dragons. These Terms of Service ("Terms") govern your access to and use of nukesdragons.com and its related services (the "Site"), operated by Wombat Factory ("us", "we", or "our"). By accessing or using the Site, or by creating an account, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

Who We Are — And Who We Aren't

Nukes & Dragons is an independent, fan-made collection of character and build-planning tools for various video games. The Site is free to use and is supported by third-party advertising. We are not affiliated with, endorsed by, or sponsored by Bethesda Softworks, ZeniMax Media, Microsoft, CD Projekt, Obsidian Entertainment, Warhorse Studios, or any other game publisher or developer. All game names, trademarks, artwork, and related materials are the property of their respective owners and are referenced here for identification and informational purposes only.

Eligibility

You must be at least 13 years old to create an account or use the interactive features of the Site. If you are below the age of majority in your jurisdiction, you may use the Site only with the involvement of a parent or guardian. By creating an account, you represent that you meet these requirements and that the information you provide is accurate.

Your Account

  • You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
  • You agree to provide accurate information and to keep it up to date.
  • You may sign in with an email address and password, or by linking a third-party account such as Discord.
  • Notify us promptly at nukesdragons@gmail.com if you believe your account has been compromised.
  • You may not maintain multiple accounts for abusive purposes or impersonate another person.
  • You may deactivate your account or request permanent deletion from your account settings. Deactivation hides your public profile until you sign back in; permanent deletion is intended to remove your account and builds, subject to the retention described in our Privacy Policy.

User Content

The Site lets you create, save, and share content such as character builds, build descriptions, profile details, and your chosen username ("User Content").

Ownership And License

You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, adapt (for example, to format it or generate previews), and distribute that User Content for the purpose of operating, promoting, and improving the Site. This license continues for as long as your User Content remains on the Site and for a reasonable period afterward to allow for backups and removal. Builds you mark as public, and the contents of your public profile, may be viewed by anyone — including people who are not signed in — and may be indexed by search engines. Other users may also view a public build's configuration and use it as a starting point for creating their own builds.

Your Responsibilities

You are solely responsible for your User Content and represent that you have the rights necessary to submit it. You agree not to post content that:

  • is unlawful, infringing, defamatory, obscene, hateful, or harassing;
  • infringes any third party's intellectual property, privacy, or other rights;
  • contains malware, spam, or unsolicited advertising;
  • impersonates any person or misrepresents your affiliation; or
  • otherwise violates these Terms or any applicable law.

We are under no obligation to monitor User Content, but we may review, remove, or restrict any content, and suspend or terminate any account, at our discretion — for example, content we believe violates these Terms.

Acceptable Use

When using the Site, you agree not to:

  • attempt to gain unauthorized access to the Site, to other users' accounts, or to our systems;
  • interfere with or disrupt the Site, including by overloading it, scraping it abusively, or circumventing rate limits or security measures;
  • harvest personal information from the Site or use public content to spam, harass, or profile users;
  • use the Site to violate the rights of others or any applicable law; or
  • reverse engineer or misuse any part of the Site, except as permitted by law.

Copyright Complaints

We respect intellectual property rights. If you believe content on the Site infringes your copyright, please send a notice to nukesdragons@gmail.com that includes: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location on the Site; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act; and (f) your physical or electronic signature. We will respond to valid notices, may remove the material, and may terminate the accounts of repeat infringers.

Account Termination

You may stop using the Site, deactivate your account, or request permanent deletion at any time from your account settings, or by contacting us. We may suspend or terminate your access at any time if you violate these Terms, create legal or security risk, or if we discontinue the Site. Provisions that by their nature should survive termination — including ownership, license grants for content that remains on the Site, disclaimers, limitation of liability, indemnification, and legal or security records retained under our Privacy Policy — will survive.

Disclaimers

The Site is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any build, calculation, or game data presented is accurate or complete. Game mechanics and data are provided for planning and entertainment purposes only.

Limitation Of Liability

The Site is provided free of charge. To the fullest extent permitted by applicable law, Wombat Factory and its operators will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Site. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law. If you are a consumer, your mandatory statutory rights are not affected by these Terms.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Wombat Factory and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Site, or your violation of these Terms or the rights of others.

Changes To These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and we may communicate material changes through the Site. Your continued use of the Site after the changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of Finland, without regard to its conflict-of-laws principles. Any dispute relating to these Terms or the Site will be subject to the jurisdiction of the Finnish courts. If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms deprives you of the protection afforded by the mandatory provisions of the law of that country, including the Finnish Consumer Protection Act where applicable.

General

These Terms, together with our Privacy Policy, make up the entire agreement between you and us regarding the Site and supersede any prior agreements on that subject. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. You may not assign or transfer these Terms, in whole or in part, without our prior written consent; we may assign or transfer these Terms, including as part of a merger, acquisition, or sale of assets as described in our Privacy Policy. Any rights not expressly granted to you are reserved.
